Non-Disclosure Agreement (NDA)
This Non-Disclosure Agreement ("Agreement") is made between Society for Animal Safety (SAS) India ("Disclosing Party") and the individual or organization ("Receiving Party") reporting a case to SAS India.
By reporting a case to SAS India, the Receiving Party agrees to the following terms and conditions:
1. Confidentiality of Documents
1.1 The Receiving Party agrees that any form of legal or non-legal document provided by SAS India, including but not limited to warning letters, legal notices, RTI drafts, and case-related communications, shall not be shared with any individual, organization, law enforcement agency, social group, or social media platform without the prior written authorization of SAS India.
2. Exclusive Case Handling
2.1 SAS India operates under unique protocols and approaches in Animal Welfare Litigation. The Receiving Party agrees not to report the same case to another organization simultaneously. If SAS India determines that the case has been duplicated or reported to another organization, SAS India reserves the right to reject the case, and any fees paid shall be non-refundable.
3. Restrictions on Public Statements
3.1 The Receiving Party is prohibited from making any social media posts, public statements, or press releases in print or digital media regarding the case or SAS India's involvement without prior written permission from SAS India.
4. Breach of Agreement
4.1 Any breach of this Agreement by the Receiving Party, including unauthorized disclosure of documents, duplicate reporting of cases, or unapproved public statements, will result in immediate termination of services by SAS India. SAS India also reserves the right to pursue legal action against the Receiving Party for any damages arising from such a breach.
5. Duration of Confidentiality
5.1 The obligations of confidentiality under this Agreement shall remain in effect indefinitely, even after the conclusion of the case or termination of the relationship between the Receiving Party and SAS India.
6. Governing Law and Dispute Resolution
6.1 This Agreement shall be governed by and construed in accordance with the laws of India. Any disputes arising from this Agreement shall be resolved through arbitration in Pune, Maharashtra, India, in accordance with the Indian Arbitration and Conciliation Act 1996. The decision of the arbitrator shall be final and binding.
